SPCC Plan Guidance
Help is available for facilities that must prepare, or
amend, and implement SPCC Plans to address the
potential for a discharge of oil. The majority of the
guidance is available on EPA's Emergency Management website;
however, a recent (December 2009) EPA webinar has
been archived and is now available in several electronic formats with
audio. At over 60 detailed slides, it is one of the
best public sources available to help answer many
subject facility questions on applicability, exemptions,
specific source requirements, and deadlines.
Electronic versions of the Tier I qualified facility SPCC Plan
template in 40 CFR 112, Appendix G are now
available from EPA. The template is intended to help
the owner or operator of a Tier I qualified facility
develop a SPCC Plan to self-certify. To use the
template, the facility must meet all of the following
criteria:
- a total aboveground oil storage capacity of 10,000
gallons or less;
- no aboveground oil storage containers with a
capacity greater than 5,000 gallons; and
- in the 3 years prior to the date the SPCC Plan is
certified, had no single discharge of oil to navigable
waters or adjoining shorelines exceeding 1,000
gallons, or no two discharges of oil to navigable
waters or adjoining shorelines each exceeding 42
gallons within any 12-month period.
Custom Environmental Services has recently
prepared SPCC plans for oil and gas production
operations, city vehicle maintenance operations, a
chain of vehicle oil change facilities, and construction
companies and has used the Tier 1 template;
this format really seems to be a time-saver.

California Materials Exchange Service
The California Department of Resources Recycling
and Recovery's (CalRecycle),
California Materials Exchange CalMAX service helps jurisdictions, businesses, and
organizations find "green" alternatives to throwing
away valuable materials by buying and selling them
on the Web.
CalMAX works similarly to Craigslist or eBay, but for
commercial and nonprofit enterprises. After creating a
CalMAX account online, businesses can post free
listings for a variety of goods from pavers and rubber
scrap to hand soap and file cabinets. Businesses
looking to purchase items can search the website for
affordable, hard to obtain, or free supplies. Searches
can be done by region or statewide. If you haven't
checked it out lately, you'll be pleasantly surprised.

EPA Regulatory Agenda
The
Semiannual Regulatory Agenda for each federal
government agency was published in the April 26,
2010 Federal Register. The agenda describes the
regulatory actions that are under development or
recently completed for each agency.
Select "Environmental Protection Agency" and view all
the prerule and proposed rules scheduled for action
this year.

CA Manifest Verification Fee
The 2010 Verification Questionnaire and Manifest Fee
Assessment is scheduled to be mailed mid-June to
about half of the permanent and temporary EPA ID
number holders in California. The
list of FAQs has been updated and seems very
helpful. DTSC will again be managing dedicated
telephone lines and staff to help answer calls on how
to complete the forms. 877-

CA WRAP Award Applications Solicited
The California Department of Resources Recycling
and Recovery (CalRecycle)
is currently accepting applications for its 2010 Waste
Reduction Awards Program (WRAP) through June 15,
2010. California businesses, private schools, and
nonprofit organizations that have made strides in
recycling, waste reduction, green procurement, and
other environmentally friendly programs are
encouraged to apply.
All winners will receive authorization to use the WRAP
promotional logo on their products, in advertising, and
on business Web sites to help market their efforts to
make a significant contribution to the environment. In
2009, more than 200 businesses received recognition
through WRAP. Guidelines and application are
available on the WRAP
website. Winners will be announced this fall. For

DTSC Targeted Site Investigations
Under the U.S. Small Business Liability Relief &
Brownfields Revitalization Act of 2002, DTSC has been
awarded $1.5 million each fiscal year of which
$550,000 per fiscal year is allocated to the Targeted Site Investigation (TSI)
program. The TSI funds are intended to provide
state and local governments, school districts,
redevelopment agencies, and non-profit organizations
an opportunity to gain more information about a site's
condition, which can directly affect decisions on
property acquisition or development. DTSC, along with
the Water Quality Control Board, selects eligible
Brownfields sites for the TSI program through a
competitive application process. Although direct
funding is not provided, the selected Brownfields sites
receive environmental investigative services at no cost
to the applicant. DTSC also provides technical
oversight to ensure that the TSI funds are utilized in an
effective manner and helps facilitates the decision
making process. Previous awarded services have
ranged from $45,000 to $150,000.
Dates for the 2010 TSI informational workshops will
be announced
by June 2010. Anticipated schedule includes:
- July 2010: TSI Application available and
Workshops
- August 2010: TSI Application deadline
- September 2010: Decision notices for TSI
Applications will be issued
- October 2010: Site-specific activities will be
initiated
- April 2011: Project completion is anticipated on or
before

Proposed New TRI Chemicals
On April 6, the EPA proposed its first expansion of the
Emergency Planning and Community Right-to-Know
Act (EPCRA), Toxic Release Inventory (TRI) program in
more than a decade. TRI is a publicly available EPA
database that contains information on toxic chemical
releases and waste management activities reported
annually by certain industries and federal
facilities. Specifically, EPA would like to add 16
chemicals to the list of reportable chemicals because
EPA has
concluded that the additional chemicals could cause
cancer in humans. Chemicals to be added include
furan, 4 polycyclic aromatic compounds (PACs), and
11 other less common chemicals Comments on the
proposal are due by June 7, 2010.

2009 TRI Reports due July 1, 2010
On April 16, 2010, EPA announced the availability of
the latest version of the TRI-MEweb
reporting software application. They have also
separated their guidance into "first-time filers" and "experienced filers".
Remember
that 3
chemicals on the current list (methyl mercaptan,
hydrogen sulfide, and 2, 2-dibromo-3-
nitrilopropionamide) are under administrative stays,
and are not currently reportable.
Each California facility submitting data to the EPA TRI
must also file a copy of its forms with DTSC. California facilities that
use the TRI-MEweb software need to print their TRI
reports
for submittal to DTSC (versus electronic submittal
allowed for EPA). California facilities whose total
waste management (e.g., recycling, treatment,
releases, energy recovery or other disposal) must
submit the more detailed Form R to DTSC even
though Federal rules may allow them to submit the
less detailed Form A to EPA.

TRI Webinar
The Environmental Council of the States (ECOS) and
EPA are hosting the 2010 TRI Webinar titled "Using
TRI to Support Environmental Justice". The purpose
of the Webinar is to share lessons learned using TRI
to address environmental justice concerns and
expand TRI use among current and potential users
who work on environmental justice issues. Speakers
will include representatives from EPA headquarters
and regions, non-profit organizations, and academia.
The objectives of the Webinar, agenda, and
registration information are available online. You will receive

More Chemicals Identified as Substances of Very High Concern
Member State Competent Authorities and the
European Chemicals Agency (on behalf of the
European Commission) have proposed 8 relatively
common chemicals as "Substances of Very High
Concern" (SVHC) because of their potentially
carcinogenic, mutagenic, and/or toxic for reproduction
effects on human health. Step 2 competent authority
authorization (i.e., nomination) and public comment
period has been completed. Step 3 (applications for
authorization by industry) follows. Applications for
authorization need to be made within the set
deadlines for each use that is not exempted from the
authorization requirement.
There are already 29 chemicals on the candidate
list.
The additional 8 chemicals include:
- Trichloroethylene
- Boric acid
- Sodium chromate
- Potassium chromate
- Ammonium dichromate
- Potassium dichromate
- Disodium tetraborate, anhydrous
- Tetraboron disodium heptaoxide, hydrate
Candidate SVHCs will be gradually included in Annex
XIV of the REACH Regulation. Once
included in that Annex, they cannot be placed on the
market or used after a date to be set (aka "sunset
date") unless the company is granted
an authorization. Authorizations mean new
information requirements for suppliers of
preparations
and articles containing the SVHCs.

process or guidance on
exporting chemicals to the European Union is
available on the European Chemical Agency website.

CIWQS Data Easier to Access
A variety of reports are now newly available or
improved at the public portal for the California State
Water Boards' California Integrated Water Quality
System (CIWQS) project
database.
Facility-at-a-Glance includes owner, violations,
inspections,
and orders and other regulatory measures issued to a
facility.
Regulated facilities
includes search by city, region, facility type, and status,
and covers all SWRCB programs.
Violation Report--Searches can be
refined by violation source (e.g., spills, inspections,
complaints), date, region, or agency.
Enforcement Orders--Similar to
before, but now updated nightly.
Penalty Project Report--This
new search feature shows a list of enforcement
actions that have a Supplemental Environmental
Project (SEP) and/or a Compliance Project (CP).

ECHO Improvements
EPA's Enforcement & Compliance History Online (ECHO)
has improved options for customizing facility search
reports. ECHO All Data
Search includes all federal programs with search
criteria for location, sector, media, violation status,
watershed or even demographic profile.
An
interactive Clean Water Act 2008 Annual
Noncompliance Report Map provides information
on the smaller direct discharge permit holders (e.g.,
factories and smaller wastewater treatment plants).
Information includes how many permits have been
issued, how frequently sampling data is reviewed to
determine if violations occurred, the frequency of
violations, and the frequency of formal enforcement.
The updated State Review Framework (SRF) website
includes new reports about progress made in each
state regarding the enforcement of the Clean Water
Act, the Clean Air Act, and the Resource Conservation
and Recovery Act. The
SRF recommendations can be searched, filtered,
and retrieved with a newly added query function. Users
can search and filter SRF recommendations by round,
state, completion status, statute, and
element.
The ECHO CWA
search results now provide a link to all facilities
that have permit limits. Data is from the Permit
Compliance System (PCS) or from the modernized
system, ICIS-NPDES (Integrated Compliance
Information System - National Pollutant Discharge
Elimination System). ICIS-NPDES is gradually
replacing PCS.
The Mapping
Center summarizes all mapping options
available in ECHO.
